Collaborative Evaluation with Mediation (CEM)
3 day training for Custody and Parenting Time Disputes

NEXT TRAINING:
Wed-Fri, MAY 30, MAY 31 & JUNE 1, 2012

Register by MAY 15, 2012

Instructor(s):  Mark Harwood and Alison Taylor

This 3-day workshop will explore the current national and statewide models and standards, the recent research and literature, and outline the OFI sponsored model for service delivery.   The CEM model features a comprehensive evaluation, including:
The outcome is a written Evaluation report usable in court, based on Oregon custody law, which includes a detailed Parenting Plan based on the SFLAC form.  Clients review this with their attorneys.

This is followed by a 1-2 hour mediated settlement meeting, where parents with their attorneys may ask the evaluator important questions.  The Evaluator leaves, and the parents mediate their final changes to the evaluator's recommendations for submission to the court.

This process leads to increased rates of settlement, avoiding trial and the associated acrimony and costs for clients.
Several Oregon jurisdictions have adopted this process, creating panels of evaluators.  Others trained in this model function as private practitioners, receiving referrals through a listing of practitioners on our website.

See this website, in the EVALUATION section, for more information about our CEM model.

Usual background for Evaluators
OFI suggests that evaluators meet the current SFLAC guidelines for evaluators - the 2010 version is currently available online.  It recommends evaluators have
1) a Master's Degree or Ph.D  in a behavioral science, with  extensive knowledge of children and families, 2) specific training in evaluation, and 3) licensure in good standing,  Prior evaluation and court testimony experience is helpful.

Usual background for Mediators:  OFI suggests that mediators in this component of CEM should meet the current Oregon minimum qualifications for Domestic Relations Custody and Parenting Mediators, available online at the OJD website under "rules" section.

See the 2010 SFLAC Guidelines for Evaluators, Parent Coordinators, and Parenting Time Supervisors, available online.

Courts can order professional PC's for high conflict families to manage on-going disputes without returning to court.  Practitioners use a combination of roles, including:
PC's provide recommendations and make determinations that parents must follow for the best interests of the children, within the scope outlined by the court order or voluntary agreement of the parties.  PC's must be ordered to the case, and may be independent professionals, or may be part of a panel or court-connected service delivery system.

This course covers the theory and practice of this emerging service,
including the practical aspects of being a professional in this role.   We review the 2010 SFLAC Guidelines, the state statutes, and the ethics and standards promoted by the Association of Family and Conciliation Courts (AFCC) as well as other professional groups.  We cover typical issues in PC, and how to set up a practice.

Prerequisites:
Master's Degree or Ph.D in human services, or law degree, licensure in good standing, and extensive experience with divorce, children and adults.  Domestic relations mediation training encouraged.

For more information about qualifications of PC's, see the 2010 SFLAC Guidelines, now available online, and the Multnomah County SLR 8.137 definitions.
